Terms and Conditions for Registered Artists
This Site and related Services are provided by The Artist Hub Ltd, with registered office at Sherwood House, 41 Queens Road, Farnborough, Hants, GU14 6JP, UK and registered in England and Wales under Company Number: 10853546.
“Artist” means a person who has registered themselves on our Site(s) as a formally trained actor
“Agent” means a third party who has registered themselves as a person, firm, company or organisation using our Site(s) in their search for reviewing and signing Artists
“Content” means the information and other material or applications within our Site(s)
“New Artist” means those Artists who have not registered with The Artist Hub before
“Premium Profile” means providing the Artist with additional profile features over the standard length of duration subscription order
“Services” means services provided by The Artist Hub that may be made available by us from time to time
“Sign”, “Signed”, “Signing” means the process whereby an Agent or third-party has contacted you and notified you in writing or email that you have been registered on that Agent’s books or register
“Site”, “Site(s)” means the sites located at www.theartisthub.pro
“Us”, “us”, “We”, “we”, “Our”, “our” means The Artist Hub Ltd
“You”, “you”, “Your”, “your” means the person, firm, company or organisation browsing and/or using the Site(s)
Protection of your Information
We will maintain all data provided by you in accordance with the requirements and principles of the Data Protection Act 1998 Chapter 29.
Information Submitted by You
The Artist Hub, the Agents and any third-parties will use information supplied by you, including the personal data that you have supplied. You are solely responsible for ensuring that all information supplied by you is true, accurate, up-to-date and not misleading or likely to mislead or deceive and that it is not discriminatory, obscene, offensive, defamatory of otherwise illegal, unlawful or in breach of any applicable legislation, regulations, guidelines or codes of practice or the copyright, trade mark or other intellectual property rights of any person in any jurisdiction. You are also responsible for ensuring that all information, data and files are free of viruses or other routines or engines that may damage or interfere with any system or data prior to being submitted to our website. We reserve the right to remove any information supplied by you from our Site(s) at our sole discretion, at any time and for any reason without being required to give any explanation.
Please ensure that you do not provide any personal information that you wish to remain private.
Some of our services are provided free of charge, others require payment of a subscription or a transaction fee (as appropriate) at the rate in effect upon use of the service in question. We may offer to certain users limited “Free Trials” or other promotions, during which fees are reduced or suspended, at our sole discretion. During such promotions, users remain bound by these terms and conditions. All fees are payable upfront through to The Artist Hub Ltd. All costs generated by payment transactions are to be borne by you.
As an Artist you will be offered various lengths of duration options (for example, for one month, for three months, for six months, or for any other durations as may be offered from time to time) for the presentation of your profile information to Agents and users of our Site(s).
By selecting a length of duration option you are placing a subscription order on us and you are agreeing for that subscription order to be auto-renewed for the next same length of duration at the expiry of your existing subscription order. For example, if you order three months duration, at the end of the initial three months period a follow-on subscription order will be automatically placed for the next three months. The auto-renewing of your subscription order will continue until such time that your order cancellation request has been received and has been actioned by us as per our Cancellation Process below.
Premium Profile Order
By selecting a Premium Profile order, you have selected whether that Premium Profile order is placed for (a) a fixed duration period only or (b) for it to be an auto-renewing subscription order for each length of duration chosen. The Premium Profile order is paid in full at the time the order is placed on us. Auto-renewing subscription Premium Profile orders will automatically renew at the end of each auto-renew length of duration. The auto-renewing of your subscription Premium Profile order will continue until such time that your Premium Profile order cancellation request has been received and has been actioned by us as per our Cancellation Process below.
Subscription Order and Premium Profile Order process
Each subscription order and Premium Profile order is subject to VAT at the prevailing UK Government rulings in operation at the time.
Each subscription order and Premium Profile order can be paid via approved major debit/credit card providers.
Each Premium Profile order is paid in full at the time of order and prior to any Service being provided by us.
Where a subscription order or Premium Profile order is being offered at a promotional discounted rate, you will be charged the promotional discounted rate. Once the promotional discounted rate offer has expired, your next subscription order or Premium Profile order will be charged at the standard rate for the same length of duration thereafter.
We adhere to the Consumer Contract Regulations and these do not affect your Statutory Rights.
New Artists (those who have not been registered on The Artist Hub before) joining us may cancel at any time within 14 calendar days of submitting their first order (the ‘cooling-off period’) and agreeing to these terms and conditions, without incurring any fee or penalty during this cooling-off period. No refund is available after this period.
New Artists having completed one cooling off period would not be eligible for another.
Submission of your length of duration subscription order or Premium Profile order amounts to an offer by you to purchase our length of duration subscription order, Premium Profile order or a Service order, and is subject to our acceptance. Your length of duration subscription order or Premium Profile order starts on our acceptance of your application.
Subscription order or Premium Profile order cancellation will occur at the end of the subscription order or Premium Profile order length of duration that has been ordered or auto-renewed. For example, if you have ordered a duration of 3 months, then the cancellation will come into effect at the end of the 3 months you have ordered. The cancellation will stop future duration subscription orders or Premium Profile orders auto-renewing provided that you give us sufficient time to process the cancellation before the next auto-renewal takes place (not less than three working days before the next auto-renewal subscription order or Premium Profile order is due to be applied).
Please note, that when you have been Signed by an Agent or third-party, it is your responsibility to notify us to cancel your future auto-renewal subscription order or Premium Profile order.
Your order cancellation request should be sent to us via email from you to us at our email address (email@example.com). We will then action your order cancellation request (not less than three working days before the next auto-renewal subscription order is due to commence).
Subscription Order and Premium Profile Order Payment
Your length of duration subscription orders or Premium Profile orders are paid direct via www.stripe.com.
Once your payment has been set up it, we will automatically collect payment from you on the respective start date of your auto-renewing orders until such time that you cancel your next subscription order or Premium Profile order. Your contract is for the length of duration of each subscription order or Premium Profile order at each renewal.
When you sign up for auto-renewing subscription order or Premium Profile order payments, if you are a New Artist, your first order payment has a 14 calendar day ‘cooling-off’ period from your subscription order or Premium Profile order payment date. If you are an existing Artist, your first order payment will be taken as soon as your order is approved by us. Thereafter each auto-renewing subscription order or Premium Profile order payment will be taken on the auto-renewing order date. We will notify you in advance of any changes to any order fees. The subsequent subscription order or Premium Profile order fees will begin on the next renewal date. We will send you email confirmation of the new length of duration order, fees and payment dates once it has been placed.
If we are unable to collect your payment on the due date, we will attempt collection a second time. You will receive an email to explain this. If we fail to collect on our second attempt, our Services will be put on hold or cancelled, depending on the circumstances, and you will receive an email setting out the options open to you. Your subscription order contract will continue to run until its original end date, even if Services have been put on hold due to non-payment; your subscription order contract end date will not be extended to compensate you for any time Services are on hold.
If, on the expiry of your subscription order, you wish to re-join The Artist Hub, you would first need to settle in full any unpaid amounts on expired subscription order contracts, together with any interest and debt collection charges The Artist Hub may wish to add.
It is important that you keep your email address for payment communications up to date. It is your responsibility to do so and to notify us of any changes in your email address.
The Artist Hub reserves the right to make price changes to future duration length subscription orders, Premium Profile orders, Service orders and their auto-renewals. This will not affect your current order cost but future orders may increase in cost. We will always notify you of any changes in fees in advance of your subscription order or Premium Profile order renewal.
The Artist Hub’s Decision to Cancel an Order
The Artist Hub reserves the right to refuse or cancel orders for any Artist without explanation. In the event that an order is cancelled or refused at will by The Artist Hub, a full refund will be given for the remaining duration of that order.
We additionally reserve the right to terminate an Artist temporarily or permanently where our staff or other persons are subject to abusive, offensive or threatening behaviour.
You will be contacted on each order’s auto-renewal. Should you decide to terminate your ongoing subscription orders or Premium Profile orders with us then your profile will still be available for the duration of time quoted at your last order renewal. Should your order lapse, we may endeavour to offer you another chance to re-join before your details are removed. We may also endeavour to contact you with one more opportunity to re-join after your renewal order lapses. We do not guarantee to make any follow up offers. We cannot guarantee to retain any of your personal or professional information after your renewal order has lapsed.
If you contact us and ask to cancel with immediate effect we will then remove your online profile (including any attachments) as soon as possible. You would not be eligible for a refund in these circumstances.
When an Artist cancels their auto-renewal subscription orders or Premium Profile orders we retain their contact details in our internal database for reference purposes. However, once you are no longer an Artist, no new Agent enquiries can be made.
The Artist Hub reserves the right to archive and delete old Artist files when they have not been accessed for some time, to control the accuracy of the data held on our system, in line with the Data Protection Act.
If you are Signed by an Agent, we expect you to fulfil your commitment to your Agent. If for any reason you cannot fulfil your commitment, you must inform your Agent immediately. It is your responsibility in the first instance to let the Agent know your specific reasons that you are unable to fulfil your commitment.
Please keep us updated with any changes in your Signed status by updating your status. Depending on the reasons and circumstances, and where we deem it appropriate, we will request you to re-register on our Site.
Where you select to block an Agent from viewing your profile, it is your sole responsibility to accurately select and block an Agent, Agent’s company and any known associates of the Agent(s). The Artist Hub take no responsibility or liability for your actions in this matter. The Artist Hub cannot be held responsible or liable for any Agent knowing or getting to know that you have blocked them viewing your profile. Extreme care must be taken by you when using this feature and it is your responsibility to adhere to any terms and conditions that you may have already contractually agreed to with your Agent.
By registering with us, you understand and agree that you are not an employee of The Artist Hub Ltd. Rather, you agree that you are retaining The Artist Hub to perform Services for you, unless otherwise agreed.
Any work undertaken is between you and the Agent. You agree that you are liable and responsible for your own Income Tax and National Insurance contributions as a self-employed person.
Nothing in this agreement shall render you to be an employee of The Artist Hub Ltd in any way.
The Artist Hub reserves the right at its sole discretion to remove an Artist from its Site(s) at any time and for any reason where it deems this action appropriate.
Agents and Agency Fees
The Artist Hub is not responsible for proving the validity of Agents that register themselves on our Site(s) or the accuracy of the information the Agent has provided. However, we do request that you provide us with known issues or concerns with regards an Agent or their content.
The Artist Hub does not charge you or the Agent for any form of agency joining or ongoing agency fee, either prior to or after you have been Signed. If any Agent requests any joining or agency fees then any such transaction is solely between you and the Agent.
UK and International Work
If an Agent offers UK or international work, it is your responsibility to ensure that you have valid ‘Right to Work’ proof for the country of work, and where necessary any valid travel documents, passport and/or travel visas. It should be the Agent’s responsibility to ensure any necessary and valid work permit, visa or licences are arranged for you. You will need to check that all of these have been established beforehand. None of which are the responsibility of The Artist Hub.
Press and Publicity
Any publicity, announcement, declaration or social media posting, resulting from you being Signed must be agreed by your Agent first. The Artist Hub take no responsibility for you posting any such announcements on our Site(s).
Any publicity, announcement, declaration or social media posting, resulting from you being Signed can be used by us for promotional and publicity use and you are deemed to agree to this promotion or publicity.
You agree that The Artist Hub shall not be liable for any loss or damage whatsoever arising directly or indirectly from or in any way connected with our Site(s), Content or Artist directory, including, without limitation, damage for loss of profits, loss of business, or any other consequential or pecuniary loss (even where we have been advised of the possibility of such loss or damage).
You agree and acknowledge that you are solely responsible for evaluating any Services offered by us or Agents via our Site(s), Content or Artist directory. Any Signing with an Agent shall be subject to the terms and conditions and privacy policies of the Agent and we will not be a party to or in any way responsible for or liable to you in respect of any transactions between you and any Agent.
If you breach these terms and conditions, The Artist Hub may suffer loss. You agree to indemnify us against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of any non-compliance by you.
These terms and conditions (as amended from time to time) together with any document expressly referred to in them comprise the entire agreement between you and us.
Each provision of these terms and conditions shall be construed separately, applying and surviving even if for any reason one or other provisions is held to be inapplicable or unenforceable in any circumstances.
No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.
These terms and conditions shall be governed by English law and you submit to the exclusive jurisdiction of the English Courts.
Changes to Terms and Conditions
The Artist Hub may update these terms and conditions from time to time.
